CLEAR TERMS BEFORE YOU MEET

The $200 seller consultation offer

Read these conditions before requesting an appointment. This is a fixed consultation incentive for the identified probate estate, not a sweepstakes or personal cash gift. The document and attendance requirements below are conditions of this offer; RESPA does not itself require probate documents or a 30-minute meeting.

1. Eligibility and required documents

  • You must be at least 18 and be the court-appointed personal representative: an authorized petitioner, administrator, or executor named in both the estate’s issued probate Letters (DE-150) and signed Order for Probate (DE-140). Filing a petition or receiving an unsigned proposed order does not qualify.
  • You must have received both documents and submit a clear copy of each, including issuance, appointment, and restriction pages. The form requires your full name, email address, phone number, property city, role, both uploads, and the stated confirmations. JPG, PNG, or PDF; 10 MB maximum combined.
  • Erik must receive and review both documents and confirm your eligibility before scheduling a meeting or paying funds. Any relevant court restriction or question about your authority to participate or accept funds for the estate must be resolved with your probate attorney before confirmation. Uploading documents does not itself establish authority.
  • The estate’s residential property must be located in California, with no active exclusive listing with another brokerage. No minimum property value, income, or financial qualification applies. No spouse or other co-owner attendance is required.
  • You must participate for the identified estate’s own potential property sale. Participation as a paid professional fiduciary, professional referral source, or settlement-service provider is excluded. Holding a professional license alone does not exclude someone acting solely in a personal, nonprofessional capacity for their own family’s estate. These are restrictions of this offer, not a statement that RESPA categorically prohibits every professional recipient.

2. Meeting and exact payment

  • After eligibility review, Erik confirms a scheduled, in-person consultation and its location in advance. Allow approximately 30 minutes. Complete the meeting, which includes a sales presentation about pricing, marketing, selling as is, renovation sale options, and seller representation.
  • Once the disclosed eligibility and attendance conditions are met, Erik provides a guaranteed $200 cash payment at the conclusion of the consultation. The court-appointed personal representative receives the cash on behalf of the identified probate estate; it must be treated as estate funds, not personal compensation. No immediate payment is made for submitting the form or uploading documents.
  • One $200 payment per eligible property, not per attendee, beneficiary, owner, or repeat meeting. No drawing, chance-based selection, or additional payment based on referrals, transaction value, or future business.
  • You keep the earned incentive if you decline to hire Erik, choose another broker, decide not to sell, or no transaction closes. No purchase, deposit, participation fee, listing agreement, or closing is required to receive or retain it.

3. No referral or provider requirement

  • No referral, introduction of another customer, recommendation, review, testimonial, or enrollment in marketing is required. Neither a written agreement nor an informal understanding to send business is part of this offer.
  • You need not select Erik, RE/MAX TerraSol, or any particular lender, mortgage broker, title company, escrow company, attorney, contractor, or other service provider. The incentive is not tied to any provider selection, referral history, or volume or value of business.
  • Erik funds the incentive from his own funds. It is not charged to the estate, deducted from proceeds, recovered through a settlement charge, or financed or reimbursed by a lender, title company, escrow company, or other settlement-service provider.
  • The payment is a direct estate-consumer consultation incentive. It is not a referral fee, a split of settlement charges, compensation for professional settlement services, or reimbursement of a referral source’s business expenses.

4. Availability, records, and questions

  • No fixed request deadline applies while this offer is displayed. Confirmed qualifying appointments and earned payments will be honored if the offer is later changed or withdrawn.
  • Eligibility, the meeting’s purpose and approximate duration, location, and these written payment conditions are provided before the appointment. No additional hiring or referral condition may be added later.
  • You may request and receive evidence that the promised payment matches this offer. Contact Erik at 855-423-5100 or erik@protecttheestate.com with questions or to confirm a submission.
  • Your own advisers determine the estate’s tax reporting, accounting, fiduciary duties, and any required court authorization. Designating the cash as estate funds does not itself resolve those duties or establish RESPA compliance.
