RESPA compliance disclaimer
The offer applies to qualifying probate estates with residential property located in California. The complete offer terms explain the required court documents, eligibility review, consultation attendance, and a $200 cash payment received by the authorized representative on behalf of the estate. No hiring, purchase, closing, or referral is required.
This offer prohibits referral payments, required use of another provider, and unearned settlement-fee splits. There is no $200 exemption from RESPA. Calling a payment compensation “for your time” or designating cash as estate funds does not create an exemption.
The CFPB generally permits direct consumer incentives for a provider’s own business, while prohibiting incentives exchanged for referrals of other business. The separate rule for promotional activities directed to referral sources also requires that their otherwise-incurred expenses not be paid. This offer does not rely on that exception to pay professional referral sources.
This disclaimer describes the offer’s restrictions. It is not a government certification, legal opinion, or guarantee about an actual transaction. Actual funding, recipient capacity, relationships, and conduct must follow the law. If an affiliated provider is recommended, any required ownership and estimated-charge disclosure must be delivered at the required time; this general notice does not replace it. The $200 offer cannot require use of that provider.
